General Terms and Conditions – Guests
1. General
Sun & Sea Holidays provides an online advertising and booking platform for holiday accommodation and facilitates bookings on behalf of the accommodation owner.
The rental agreement is concluded directly between the guest and the owner of the accommodation.
By making a booking, you agree to these General Terms and Conditions.
2. Rental Period
The rental period is stated in the booking confirmation.
The accommodation may be occupied from the specified check-in time on the day of arrival and must be vacated no later than the specified check-out time on the day of departure.
Key or access details will only be provided after the full rental amount has been paid.
3. Guests
3.1 Age
The lead booker must be at least 21 years old.
Groups of four or more persons under the age of 21 must be reported in advance. If this has not been reported, access to the accommodation may be refused without a refund.
3.2 Number of Guests
The maximum permitted number of guests is stated in the booking confirmation.
Children aged 2 to 12 count as guests. Babies under the age of 2 are not included in the guest count.
If the permitted number of persons is exceeded, the accommodation owner may ask additional persons to leave or terminate the rental agreement without a refund.
4. Bookings and Payments
A booking is confirmed once it has been confirmed by Sun & Sea Holidays. For accommodation booked on request, the booking is only confirmed once the owner has approved the request and the guest has received confirmation.
The full rental amount must be paid no later than 40 days before the arrival date. For bookings made within 40 days of arrival, the full rental amount must be paid immediately upon booking.
If full payment is not received on time, Sun & Sea Holidays reserves the right to cancel the booking.
In this case, the accommodation will become available for rental again.
All prices include the stated taxes. Tourist tax, a security deposit and any optional services may be listed separately and, where applicable, must be paid in accordance with the booking confirmation.
5. Liability
Sun & Sea Holidays is solely responsible for the operation of the online booking platform and the processing of payments on behalf of the accommodation owner.
Sun & Sea Holidays is not liable for:
- the condition or quality of the accommodation;
- maintenance issues;
- cleaning;
- nuisance or disturbance;
- damage or injury during the stay;
- malfunctions in or around the accommodation;
- acts or omissions of the owner;
- cancellations or changes made by the owner.
The accommodation owner remains fully responsible at all times for the stay and the performance of the rental agreement.
6. Cancellations
Cancellations must always be submitted in writing or by email.
The following cancellation conditions apply to the cancelled part of the rental period:
- Up to 30 days before arrival: free cancellation.
- From 30 days to 7 days before arrival: 50% of the rental amount is due.
- Within 7 days before arrival, on the day of arrival or in the event of a no-show: 100% of the rental amount is due.
If the full rental amount has not yet been paid at the time of cancellation, the guest remains obliged to pay the applicable cancellation charges.
If payment has not been received no later than 40 days before arrival, Sun & Sea Holidays may cancel the booking. In this case, no cancellation charges are due, as the free cancellation period has not yet expired.
7. Security Deposit and Damage
The accommodation owner may require a security deposit for the stay.
The conditions, collection and refund of any security deposit are entirely the responsibility of the accommodation owner.
Any damage or disputes relating to the stay must be resolved directly between the guest and the owner.
Sun & Sea Holidays does not manage security deposits or damage funds and is not liable for damage occurring during the stay.
8. Travel Insurance
We strongly recommend taking out appropriate travel and cancellation insurance.
Sun & Sea Holidays and the accommodation owner are not liable for costs arising from cancellations outside the conditions stated above.
9. Stay and Use of the Accommodation
Tents, caravans or similar structures may not be placed on the property.
Pets are only permitted if agreed in writing in advance.
It cannot be guaranteed that the accommodation is completely free of allergens.
Noise disturbance caused by external factors cannot be excluded.
If a swimming pool is available, all instructions must be strictly followed. Children under the age of 16 may only use the swimming pool under supervision.
10. Reporting Problems
Any problems must be reported within 24 hours of arrival using the contact details provided in the booking confirmation.
The accommodation owner remains responsible for the further handling of complaints, reports and solutions.
Sun & Sea Holidays only facilitates communication between the guest and the owner where necessary.
11. Final Cleaning
If final cleaning is included, the accommodation must be left broom-clean (waste removed, dishes washed and the refrigerator emptied).
If final cleaning is optional and has not been booked, the accommodation must be left completely clean and tidy in accordance with the instructions provided.
12. Communication and Conduct
You must communicate respectfully with the accommodation owner and other parties involved.
Inappropriate behaviour or misuse of communication may result in termination of the rental agreement without a refund.
13. Reviews
After your stay, you may be invited to leave a review. Your feedback helps us and future guests.
14. Force Majeure
In the event of force majeure, such as natural disasters, war, pandemics or government measures, either party may terminate the rental agreement without liability for damages.
15. Privacy
Personal data is processed in accordance with the Sun & Sea Holidays Privacy Policy, as published on the website.
16. Applicable Law
This agreement is governed by Dutch law.
Any disputes will be submitted to the competent court in the Netherlands.
