Supplementary Terms and Conditions Hassle-free Advertising

These supplementary terms and conditions apply to the Carefree Advertising package of Sun & Sea Holidays (“S&S”) and form an addition to the General Terms and Conditions for Owners.
In the event of any conflict between the General Terms and Conditions and these supplementary terms and conditions, these supplementary terms and conditions shall prevail.


Article 1 – Nature of the services

1.1 The Carefree Advertising package is aimed at the professional presentation and promotion of the accommodation, without S&S carrying out operational management.

1.2 Within this package, S&S acts as an advertising and reservation intermediary.

1.3 S&S is not the lessor, lessee or manager of the accommodation.


Article 2 – Activities of Sun & Sea Holidays

2.1 Within the Carefree Advertising package, S&S provides, among other things:

  • the creation and maintenance of the online advertisement;
  • publication on S&S’s own websites;
  • publication on selected external rental platforms;
  • synchronization of availability via linked calendars;
  • communication with guests prior to arrival and after departure;
  • processing of reservations and payments via the reservation system.

2.2 S&S makes every effort to achieve optimal online visibility, but provides no guarantee regarding occupancy rate, number of reservations or revenue.


Article 3 – Responsibilities of the owner

3.1 Within the Carefree Advertising package, the owner is solely responsible for all operational activities, including:

  • cleaning of the accommodation;
  • key handover and access for guests;
  • inspections before and after the stay;
  • handling complaints during the stay;
  • reporting and determining damage.

3.2 The owner shall ensure the availability of a local contact person if the owner is not personally available.

3.3 The owner is responsible for a correct and up-to-date availability calendar if this is not fully managed via S&S.


Article 4 – Prices and availability

4.1 The owner determines the rental prices. S&S may provide advice based on market knowledge and experience.

4.2 S&S processes the prices determined by the owner in the reservation system.

4.3 The risk of double bookings resulting from external or non-linked calendars rests with the owner.


Article 5 – Payments, commission and licence

5.1 For the Carefree Advertising package, the owner owes a monthly licence fee, as laid down in the contract.

5.2 In addition, S&S is entitled to charge a commission of 10% of the rental amount, unless otherwise agreed in writing.

5.3 For reservations made via the S&S website, a service fee may be charged to the guest. This fee does not affect the owner’s net proceeds.

5.4 Payment of rental income to the owner takes place in accordance with the agreements set out in the contract.


Article 6 – Damage and liability

6.1 S&S is not responsible for damage to the accommodation or inventory arising during the guests’ stay.

6.2 Damage must be determined, reported and handled by the owner.

6.3 S&S is only liable in the event of intent or demonstrable gross negligence on the part of S&S.

6.4 The liability of S&S is limited in accordance with the General Terms and Conditions.

6.5 The Sun & Sea Holidays damage fund applies exclusively to reservations made via the Sun & Sea Holidays website.
For reservations via external rental platforms, the damage policy of the relevant platform applies.


Article 7 – House rules and provision of information

7.1 The owner is responsible for drafting and enforcing house rules.

7.2 The owner shall ensure the availability of an information folder or digital information for guests.

7.3 S&S may provide standard guidelines or sample texts, without accepting responsibility for them.


Article 8 – Term and termination

8.1 The Carefree Advertising package has a minimum term of six months, unless otherwise agreed in writing.

8.2 After expiry of the minimum term, the agreement is tacitly extended for an indefinite period.

8.3 After expiry of the minimum term, termination may take place in writing, subject to the agreed notice period.

8.4 Reservations already confirmed will be handled upon termination of the agreement.


Article 9 – Applicable law and disputes

9.1 Dutch law applies exclusively to these supplementary terms and conditions.

9.2 Disputes shall be submitted to the competent court in the district where S&S is established.
